Terms of Service

1. Acceptance of Terms

By accessing or using VirtualTour ("the Service"), operated by CustomWare ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

VirtualTour is a SaaS platform that enables users to create, edit, and share immersive 360° virtual tours. The Service includes a web-based editor, hosting of published tours, and optional AI-powered features.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Subscription & Payments

Paid plans are billed monthly through Stripe. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis.

We reserve the right to modify pricing with 30 days' notice to existing subscribers.

5. User Content

You retain ownership of all content you upload to the Service (images, tours, media). By uploading content, you grant us a limited license to host, store, and serve your content as necessary to provide the Service.

You are responsible for ensuring you have the right to use any content you upload. You must not upload content that is illegal, infringing, or harmful.

6. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes
  • Upload malicious code or attempt to compromise the platform
  • Reverse-engineer or scrape the Service
  • Share or resell access to your account
  • Use AI features to generate prohibited or harmful content

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind. We may perform maintenance that temporarily affects availability.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We process data in accordance with GDPR and applicable data protection laws.

9. Termination

We may suspend or terminate your account for violation of these Terms. You may delete your account at any time. Upon termination, your content may be deleted after a 30-day grace period.

10. Limitation of Liability

To the maximum extent permitted by law, CustomWare shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance.
